1. Rights holders' remedies

Uploaders must have authority for the content and uses they request. Rights holders retain their lawful claims against uploaders and other responsible persons, including any available removal, injunctive or damages remedies. You do not need to agree to our Terms to exercise those rights. An anonymous session or a private link does not excuse infringement.

A complaint should identify the affected material precisely. Do not send passwords, entire private libraries, unnecessary identity documents or unrelated personal information. Where a link contains a private access token, provide it only through the verified complaint contact.

2. General rights complaints

Send help@🗣.fm your name and reliable reply details, the work or right involved, your authority to act, the exact Demotapes URL or track/report identifier, and a concise explanation of the alleged violation. Identify any relevant legal basis and provide supporting information sufficient to locate and assess the material. Copyright, trademark, privacy and confidentiality claims may require different legal procedures.

We will assess sufficiently specific complaints, request necessary clarification, and remove or restrict material when appropriate or legally required. A complaint alone is not conclusive proof of infringement. We will not promise to identify an anonymous user when we do not have that information.

3. U.S. DMCA notices, where applicable

To submit a notice under 17 U.S.C. § 512(c)(3), send our designated agent substantially the following:

  1. Your physical or electronic signature as the rights holder or authorized representative.
  2. Identification of the copyrighted work, or a representative list of works if multiple works at a single online site are involved.
  3. Identification of the material or activity claimed to infringe, and information reasonably sufficient for us to locate it, including specific URLs or track identifiers.
  4. Information reasonably sufficient to contact you, such as an address, telephone number and, if available, email address.
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the notice is accurate and, under penalty of perjury, that you are authorized to act for the owner of the exclusive right allegedly infringed.

Consider applicable exceptions and lawful uses before submitting. Knowingly making a material misrepresentation in a notice or counter-notice can create liability under 17 U.S.C. § 512(f). We may seek clarification of an incomplete notice.

4. Action and uploader notice

For a compliant notice handled under the U.S. process, we will act expeditiously to remove or disable access to the identified material and take reasonable steps to promptly notify the affected uploader. Notices must also be deliverable within the affected workspace where no email exists. A private or anonymous session is not an exemption from enforcement.

Restrictions should cover the original, playback derivatives, generated stems, relevant artwork/reports and all affected access routes. In the proposed hosted service this includes application playback, private Blob access grants and Dub listening links. Disabling one short link alone is not a complete takedown. We may preserve proportionate evidence where lawfully justified. We may also act on credible information or applicable legal obligations without waiting for a formal notice. A technical restriction is not a court judgment.

5. U.S. counter-notices, where applicable

If you believe material was removed through mistake or misidentification, send the designated agent:

  1. Your physical or electronic signature.
  2. Identification of the removed or disabled material and where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief removal or disabling resulted from mistake or misidentification.
  4. Your name, address and telephone number; consent to the jurisdiction of the federal district court for the district where your address is located, or, if outside the United States, any district where the service provider may be found; and a statement that you will accept service of process from the original notice sender or that person's agent.

A counter-notice contains personal information and is forwarded to the original claimant as part of this process. Consider seeking legal advice before submitting one. Do not send a counter-notice merely because you disagree with a separate, non-copyright restriction.

Under the applicable § 512(g) process, we will promptly forward a compliant counter-notice to the original claimant. Access is restored no sooner than 10 and no later than 14 business days after receipt unless the designated agent first receives notice that the claimant has filed an action seeking a court order restraining the allegedly infringing activity. A separate lawful restriction may independently prevent access; we will identify that basis rather than treat it as a copyright determination.

6. Repeat infringement and other enforcement

Our policy is to terminate access for repeat infringers in appropriate circumstances. Enforcement considers the reliability and disposition of complaints, counter-notices, legal decisions and attempts to evade restrictions. It is not a rule that every allegation automatically counts as a proven infringement or that every user receives a fixed number of warnings.

Do not open replacement sessions, change links or re-upload material to evade a restriction. The operator must implement practical session and content controls and accommodate applicable standard technical measures; a policy alone does not accomplish this.

7. Legal requests and privacy

Rights holders may seek information through applicable legal procedures. We assess the validity and scope of requests, preserve and disclose information we actually possess as required or permitted by law, and respect applicable privacy protections and lawful objections. We do not release identifying information solely because someone alleges infringement, or guarantee that anonymous users can be identified.
